E-SIGN CONSENT TO USE ELECTRONIC RECORDS AND SIGNATURES

Introduction
Zinclusive LLC, its affiliates, assignees, designees, transferees, and third-party service providers (collectively, “Zinclusive”) are required by certain laws and regulations to provide you certain information “in writing,” which means you are entitled to receive it in paper form. In order to proceed with entering into a relationship with Zinclusive, you must consent to receive this information electronically instead. In addition, you must consent to the use of electronic records and signatures in our relationship with you.
In this E-SIGN Consent to Use Electronic Records and Signatures (“Consent”), the words “we,” “us,” and “our” means Zinclusive. The words “you” or “your” means the person giving this consent and any authorized representative of that person. The word “Communications” means each document, notice, agreement, statement, disclosure, record or other information we provide to you, or that you sign or submit or agree to at our request.
Scope of Your Consent
You agree that any of the Communications we provide to you, or that you sign or agree to at our request, may be in electronic form. We may also use electronic signatures and obtain them from you on any Communication. Your consent applies to Communications for all accounts, transactions, products and services we now, or in the future, make accessible or available to you electronically, whether through our website, software application, email, messaging services (including text messages for which you may be charged by your telecommunications service provider), or otherwise.
Your consent includes, but is not limited to, Communications provided in connection with:
- Applying for and opening a line of credit account with us, including disclosures required by the Truth in Lending Act, Equal Credit Opportunity Act, Fair Credit Reporting Act, and other federal and state laws and regulations.
- Servicing, maintenance, use, operation or closing of your line of credit account; and
- Performing any transactions or obtaining information on your line of credit account.
All Communications that we provide to you in electronic form will be delivered in one of the following formats: (1) on a website or mobile application we maintain or utilize for the purpose of conducting business with you, (2) via email, including via attachments or embedded links, (3) via a software application, or (4) by you accessing a website or other electronic means that we will designate in an email, text message or other electronic notice we send to you at the time the Communication is available.
From time to time, you may seek to obtain a new product or service from us. When you do, we may remind you that you have already given us your consent to use electronic records and signatures. If you decide not to use electronic records and signatures in connection with the new product or service, your decision does not mean you have withdrawn this consent for any other product or service.
We may always, in our sole discretion, provide you with any Communication on paper, even if you have authorized electronic delivery. Sometimes the law, or our agreement with you, requires you to give us a written notice. You must still provide these notices to us on paper, unless we tell you how to deliver the notice to us electronically.
Withdrawing Consent
You may withdraw your consent to receive Communications electronically by contacting us at support@zinclusive.com, by calling us at 866-516-8001, or by regular mail at Zinclusive, LLC, 3100 W Ray Rd., Suite 201, Chandler, AZ 85226. Your withdrawal of consent will be effective only after we have had a reasonable period of time to process your request. The legal effectiveness, validity and/or enforceability of Communications we sent prior to withdrawal will not be affected.
Withdrawal of your consent may result in the termination of your access to our electronic services, including your access to your account through our website or mobile application, and your access to use certain products and services. If you have a pending credit request or application in process with Zinclusive, or an extension of credit that has been approved and is in the process of funding, withdrawing your consent will terminate your credit request or application and will result in the cancellation of any funds in process of disbursement (except where prohibited by law). If you have an outstanding line of credit and are receiving Periodic Statements electronically, the withdrawal of your consent may cause you to lose access to make additional draw requests and will cause paper statements to be mailed to you at your address currently on file with us.
Retaining Copies and Paper Copies
We encourage you to print or download a copy of all electronic Communications for your records, including this Consent and any other record that is important to you. To obtain paper copies of any documents, you may print the electronic version of the document with your printer or by requesting a paper copy at no charge by calling us at 866-516-8001 or e-mailing us at support@zinclusive.com. We will not be obligated to provide a paper copy unless you specifically request us to do so.
Updating Your Contact Information
You agree to maintain a valid e-mail address and mobile phone number and promptly notify us of any changes to your contact information. You may update your contact information at any time by logging in to your account on www.zinclusive.com and updating your contact information. You may also call us at 866-516-8001.
System Requirements
To access and retain the electronic Communications, you must have: (1) a personal computer or other device capable of accessing the Internet; (2) internet access; (3) a valid e-mail address; (4) a widely-used, recent-generation web browser that we support (for example, Chrome or Firefox); (5) a current version of a program that accurately reads and displays PDF files (such as Adobe Reader 8 or above); and (6) a printer, hard drive or other storage capability.
If you access our website and any Communications electronically via a mobile device (such as a smartphone, tablet, and the like), in addition to the above requirements you must be able to print and save Communications. If you do not have these capabilities on your mobile device, please access our website through a device that provides these capabilities.
Your access to our website verifies your ability to meet the requirements listed above. If our hardware or software requirements change, and that change would create a material risk that you would not be able to access or retain electronic Communications, we will give you notice of the revised hardware or software requirements and will allow you to withdraw consent without imposing any fees. Continuing to use our services after receiving such notice of the change is reaffirmation of your consent.
